Welcome to ArtechFlows. These Terms of Service ("Terms") govern your access to and use of the ArtechFlows workflow automation platform and services (the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using ArtechFlows, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms, you may not use our Service.

You represent that you are at least 18 years old and have the legal capacity to enter into this agreement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

ArtechFlows provides a cloud-based workflow automation platform that enables businesses to automate tasks, integrate applications, and streamline operations using AI-powered tools. Our Service includes:

• Workflow design and automation tools
• Integration with third-party applications and services
• AI-powered automation features
• Analytics and reporting dashboards
• Team collaboration tools
• Customer support and documentation

3. Account Registration and Security

3.1 Account Creation

To use our Service, you must create an account by providing accurate, current, and complete information. You agree to maintain and update your information to keep it accurate and current.

3.2 Email Verification

After registration, you will receive a verification email via AWS SES. You must verify your email address to activate your account and access certain features. This helps us ensure account security and prevent unauthorized access.

3.3 Account Security

You are responsible for:

• Maintaining the confidentiality of your password and account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Using strong, unique passwords and enabling two-factor authentication when available

4. Subscription Plans and Payments

4.1 Free Trial

We offer a 14-day free trial for new users. No credit card is required for the trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service.

4.2 Paid Subscriptions

Subscription fees are billed in advance on a monthly or annual basis, depending on your selected plan. You agree to pay all fees associated with your subscription. We accept payment via credit card, debit card, and other methods as specified.

4.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date. You will receive a billing invoice via email (sent through AWS SES) prior to each renewal.

4.4 Refund Policy

We offer a 30-day money-back guarantee for new paid subscriptions. If you are not satisfied with our Service, contact us within 30 days of your initial purchase for a full refund. Refunds do not apply to renewals or additional services.

4.5 Price Changes

We reserve the right to modify subscription prices. We will notify you at least 30 days in advance of any price changes via email. Price changes will take effect at your next billing cycle.

5. Acceptable Use

5.1 Permitted Use

You agree to use the Service only for lawful purposes and in accordance with these Terms.

5.2 Prohibited Activities

You agree NOT to:

• Violate any applicable laws, regulations, or third-party rights
• Use the Service to transmit harmful, offensive, or illegal content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) without our explicit permission
• Reverse engineer, decompile, or attempt to extract the source code
• Resell, rent, or lease the Service without authorization
• Remove or alter any proprietary notices or labels
• Use the Service to send spam or unsolicited communications
• Exceed rate limits or usage restrictions for your subscription tier

6. Email Communications

6.1 Transactional Emails

We use AWS Simple Email Service (AWS SES) to send transactional emails essential to your use of the Service. These emails include:

• Account verification and email confirmation
• Password reset requests and security alerts
• Billing invoices and payment confirmations
• Workflow notifications and usage alerts
• Critical service updates and maintenance notices

6.2 Marketing Communications

With your consent, we may send you promotional emails about new features, updates, and offers. You can opt out of marketing emails at any time by clicking "unsubscribe" in any marketing email or by adjusting your account preferences.

6.3 Email Compliance

Our email practices comply with the CAN-SPAM Act, GDPR, and AWS SES policies. We never sell your email address or send emails on behalf of third parties.

7. Intellectual Property Rights

7.1 Our Rights

The Service, including all content, features, functionality, software, and design, is owned by ArtechFlows and protected by copyright, trademark, patent, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our explicit written permission.

7.2 Your Rights

You retain all rights to the data, workflows, and content you create using our Service. By using our Service, you grant us a limited license to host, store, and process your content solely to provide the Service to you.

7.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use that feedback without any obligation to you.

8. Data Privacy and Security

We take data privacy seriously. Our collection, use, and protection of your information is governed by our Privacy Policy. We implement industry-standard security measures including:

• Encryption of data in transit (TLS/SSL) and at rest (AES-256)
• Regular security audits and penetration testing
• SOC 2 Type II compliance
• Access controls and authentication measures

9. Service Availability and Modifications

9.1 Uptime

We strive to provide 99.9% uptime for paid plans. However, the Service is provided "as is" and we do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice.

9.2 Service Changes

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable notice for significant changes that materially impact functionality.

10. Third-Party Integrations

Our Service integrates with third-party applications and services. Your use of third-party integrations is subject to the terms and policies of those third parties. We are not responsible for third-party services, their availability, or their handling of your data.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTECHFLOWS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless ArtechFlows and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

13.1 By You

You may cancel your account at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will continue to have access to the Service until that time.

13.2 By Us

We may suspend or terminate your account if you violate these Terms, fail to pay fees, or engage in activities that harm our Service or other users. We will provide notice when reasonably possible.

13.3 Effect of Termination

Upon termination, your right to use the Service immediately ceases. You may export your data within 30 days of termination. After 90 days, we may delete your data in accordance with our data retention policies.

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

14.2 Arbitration

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in San Francisco, California, rather than in court, except that you may assert claims in small claims court.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ArtechFlows regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email (via AWS SES) or through a prominent notice on our platform. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
